My Platform

UPDATE: This is eschewed in favor of anarcho-capitalism.

Were I to serve in political office--yeah, right, like that would ever happen!--this would be my platform:

Business

  • Repeal all labor laws and regulations, including accounting and reporting requirements.
  • Remove barriers to free trade. The removal of international barriers to free trade (e.g., import tariffs, protectionism) must follow the freeing up of domestic businesses of government burdens.
  • End all federal meddling in "interstate commerce" and "general welfare" that isn't explicitly, specifically authorized.
  • Constitutional amendment forbidding the conferring of personhood upon nonpersons, as this practice defies Natural Law. Effects of this amendment would include the elimination of corporate status (corporations as we now know them) and the restoration of individual accountability.
  • Eliminate business licenses and requirements for professional or educational accreditation. Let the free market judge competence and the service/product provider be accountable.
  • Remove the Postal system's monopoly on first class mail.
  • Constitutional amendment to disband and disallow the federal Postal system.
  • Privatize (sell) all federal real estate and forbid federal ownership of real estate, amending Article I, Section 8, appropriately.
  • Privatize transportation infrastructure.
  • Privatize or simply eliminate the FDA, FCC, SEC, and other regulatory and oversight organizations.
  • Over time, privatize as much government function as possible. This is not a delegation of government force to private organizations, though, but is a denial of the use of force. In this manner, government should continually shrink for decades to come.
  • End copyright and patent protection. (Trademark and servicemark protection can still be found in civil charges of identity fraud when abused.)
  • End FDIC and any federal insurance.
  • End banking regulations.

Corruption in Government

  • Impeach, remove, and indict all judges "reinterpreting" the Constitution or law in a manner inconsistent with a Textual Originalist understanding or in violation of Natural Law.
  • Impeach, remove, and indict all Congressmen with voting records inconsistent with their Constitutional authority.
  • Defund, disband, and dismantle all agencies without explicit, direct, Constitutional authorization.
  • Repeal all laws anathema to the Constitution.
  • Repeal the Seventeenth (Senatorial elections) Amendment.
  • Disband the secret service.
  • Any actions of grossly unconstitutional lawmaking (or policy, regulation, etc.) are to be considered acts of treason.
  • Eliminate all salaries and benefits for elected offices.
  • End two-party stranglehold over ballot access. End party system altogether.
  • Voting process, mechanisms, procedures, and tools (including source code) are to be fully transparent and publicly available.
  • Restrict voting to the qualified. This means some kind of test is required. Serving in office or on juries also requires passing this test. Qualifications might include things like:
    1. A worldview socially compatible with the Biblical one.
    2. A good understanding of economics (i.e., Austrian model).
    3. A good understanding of history (so we don't repeat mistakes).
    4. A good understanding of government.
    5. Proficient literacy.
    6. Landowner (minimum acreage/value?).
    7. Lawful.
    8. Citizen.

    When I say "good understanding" here, I mean an understanding that far surpasses the garbage taught in government schools. Given today's population, I estimate no more than 0.1% would qualify. This voting requirement would probably have to be a Constitutional amendment.

  • The body of statutes must be knowable by the citizenry. For example, laws may not be so numerous as to be reasonably unknowable.
  • The power to regulate is the power to legislate. Therefore, regulation may not be delegated by state legislatures or Congress, as this fundamentally alters the structure of government from a republic to an oligarchy.
  • To prevent any hope of lasting corruption, every fifty years and all at once (within a single year), all civilian government employees, elected, appointed, or merely employed or contracted, are to sever their involvement in government in any form, not to be resumed for the rest of their lives. In this way, government is wholly renewed with little chance of self-perpetuation. This applies to government at all levels (federal, state, local). This requires a Constitutional amendment, of course.
  • Amend Article III, Section 3: Treason against the United States shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. Instead, it should read: Treason against the United States shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort, or in overtly violating the limitations of this Constitution.
  • Any government representative, employee, appointee, or elected officeholder, may be charged with treason should they overstep their Constitutional authority, assuming two witnesses to the same overt act.
  • Charges of treason against federal officers, agents, employees, judges, etc., may be filed in state courts, thereby avoiding federal corruption. Likewise, charges of treason against state officials may be filed in federal courts.
  • Representatives shall be apportioned for no more than 60,000 people and no fewer than 30,000 people per district.
  • Gerrymandering shall be outlawed.
  • Constitutional amendment outlawing any census, other than quantifying qualified and registered voters every 10 years for the purpose of apportionment of Representatives.

Courts

  • End punitive damages.
  • Since corporations are nonpersons, restitution is paid by those corporate principals found responsible for the convicted offense.
  • Reinstate jury nullification.
  • All court hearings, trials, judgments, and appeals, may have jury oversight if requested by the defendant or plaintiff. This includes the Supreme Court.
  • Jurors are paid what they lose in wages during their service, funded by the loser of the case. Sequestering will not be practiced.
  • Final interpretive judgment of the Constitution is in the hands of the jury, not the Supreme Court.
  • As jurors come from the pool of registered voters, and since voters must pass a difficult qualification test, jurors will finally be educated, informed, and intelligent enough to understand principles of law, despite the snow-jobs of judges and lawyers.
  • The "jury of peers" can include jurors who know the defendant well.
  • "Innocent until proven guilty" shall be codified.
  • Common law will be restored, replacing present statute law.
  • Prosecutors' offices are to be terminated. Criminal prosecution is to managed similarly to civil, where private citizens bring charges and try cases.

Crime

  • Constitutional amendment to outlaw police forces.
  • Repeal all firearms laws. Encourage all lawful citizens to be armed for the protection of their families, communities, and nation.
  • Repeal all drug laws and regulations.
  • Repeal all laws creating "meta-crimes" (so-called crimes where nobody's rights have been violated).
  • Phase out prisons in favor of full restitution when possible and capital punishment otherwise. Since "meta-crimes" will be no more, the number of real criminals will dramatically drop. As crimes are only those acts which violate others' rights, restitution is the most common sentence. For crimes that have no restitution (e.g., rape, murder), the death sentence is warranted. Jails may still be utilized for incarceration between arrest and execution of sentencing. Failure to make restitution warrants the death penalty.

Defense

  • Recall all American troops from foreign lands. The primary goal of any standing Army, Air Force, and Navy is to defend our borders.
  • Privatize much of national defense.
  • Promote and encourage volunteer participation in the militia; that is, able-bodied and armed men.
  • Close the borders to illegal immigration by empowering lawful citizens to use force (up to and including deadly force) to remove such invaders.
  • Close the borders to smugglers with full-coverage inspections of all visitors, immigrants, and cargo. Some R&D will be necessary to help with inspection of all incoming cargo, preferably done on ship prior to reaching our shores (e.g., as containers are loaded in foreign ports, they can be scanned for WMD). Manpower can be found in the military, as this is key to the defense of our borders.
  • U.S.-based transportation carriers and their contents/passengers (e.g., ships, planes) are protected as U.S. property/citizens until disembarkation. This comes into play, for example, in cases of terrorism, hijacking, piracy, and the like, which would be seen as attacks on U.S. soil.
  • Any act of war against the U.S. (citizens, land, property) may be met with retaliatory attacks unrestricted by the "proportional response" doctrine. It may be in our interest not to respond at all, to respond proportionately (to allow for future healing of the international relationship), or even to respond with utter annihilation. This policy--specifically the possibility of a disproportionate response--should be made well known in the international community.
  • Create missile defense shield.
  • Create WMD detection capability and deploy on our borders. This would cover delivery methods other than by missile.
  • Restore and build up our nuclear arsenal, including updated methods of delivery as well as multi-megaton strategic weapons.
  • Chemical and biological agents of warfare may be researched, especially to develop domestic defenses against such attacks, but they are also a valid tactic in U.S. warfare.

Economics

  • Disband the Fed.
  • Restore the gold standard.
  • End inflation. Inflation is wholly created by government printing of more money (fiat currency) or by arbitrarily devaluing the cash-gold exchange rate (if on the gold standard).
  • Sell all federal gold reserves to U.S. citizens to help pay debts.
  • Constitutional amendment to end all wealth redistribution, welfare, subsidies, social security, government health-care, etc.
  • Constitutional amendment to repeal this clause of Article I, Section 8: To borrow Money on the credit of the United States. Government debt is to be discouraged.
  • Constitutional amendment to repeal this clause of Article I, Section 8: To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures. The free market shall determine what commodity should serve as money (e.g., gold). Private industry is more than capable of standardizing weights and measures.
  • Constitutional amendment to repeal this clause of Article I, Section 8: To provide for the Punishment of counterfeiting the Securities and current Coin of the United States. Irrelevant, when the free market manages itself. Any counterfeiting therein is simply fraud, and no Constitutional authorization is needed to lay such charges.
  • Create debt repayment schedule for all federal debts. This may require a complex contract with each citizen-family to insure equity among citizens and debtors.
  • End all federal spending not explicitly authorized by the Constitution.

Education and Family

  • Constitutional amendment protecting parental rights, including unqualified and unregulated control over education.
  • End government schooling.
  • Constitutional defense of marriage (one man, one woman).
  • Insofar as marriage is a contract, marital unfaithfulness may be tried as a civil case.
  • End DFACS and related organizations.
  • Children have no rights that trump the rights of parenting except life (permanent bodily harm constitutes a violation of the right to life) and habeas corpus. (Though habeas corpus does not grant the courts any power of interference in parenting--save producing the child before the open court--it does open up the possibility of social pressure against any potentially abusive parents.)

Foreign Policy

  • Pull out of NATO, the U.N., and all other such international organizations (including IMF, etc.).
  • Give the U.N. two years to vacate our nation and then annex its facilities on U.S. soil.
  • Recall all American embassies, consulates, and ambassadors from foreign lands. Foreign relations will subsequently resume under a new policy of nonintervention.
  • Eliminate the President's power to wage war without Congressional declaration thereof. This is already Constitutionally limited, but a clarification of terms is in order. For example, there's no such thing as "peacekeeping" or "police action" that isn't war.
  • Stop all aid to foreign nations.
  • End all federally imposed trade sanctions.
  • Nullify all treaties. This will need to be done slowly and with above-board explanation and warning.
  • Amend the Constitution to remove any and all power to make treaties.
  • Forgive all current, foreign debt to the U.S.
  • Any foreign-based business conducted in the U.S. is subject to U.S. laws and courts, including product/service liability, property ownership, business accountability (i.e., charges of fraud would be levied against foreign business principals rather than the unrecognized corporations themselves).
  • While the U.S. will no longer be the world's policeman, if foreign nationals are indicted in U.S. courts (assuming jurisdiction is legitimate--Americans' rights are violated), they will be arrested and tried should they subsequently enter the U.S. or be extradited to the U.S.
  • End diplomatic immunity.
  • The U.S. will support foreign extradition of legal residents or citizens of the U.S. should they be indicted in a foreign nation via due process and charges customarily akin to that of the U.S. For example, murderers and thieves will be handed over, but those committing sedition in a foreign land will not be handed over as it's a protected right in the U.S.

General Welfare

  • Constitutional amendment declaring English as the national language, required of all citizens and legal residents who are here for more than 6 months. Anyone who cannot speak, read, and write proficient English must be able to prove legal residency for fewer than 6 months, else they may be reasonably considered illegal invaders. (Excepting infants and mentally retarded, of course.)
  • Declare America a Judeo-Christian nation (the Bible being the foundation of its inception and design). (If necessary, a Constitutional amendment may be included to explicitly say this, since the obviousness of this seems to have been lost over the centuries.) Incompatible worldviews are not welcome and will not be tolerated at the expense of our values.

Liberty

  • Repeal all environmental laws and regulations.
  • Repeal any government requirement for insurance of any kind.
  • Restoration of habeas corpus without exception.
  • Eliminate all forms of government identification of its citizens (e.g., SSN, D/L).
  • End any possibility of conscription (the draft), as this is nothing but slavery.
  • At any 10-year interval, any state so desiring may secede peacefully from this voluntary Union, retaining all federal assets within its borders. Application to rejoin the Union may be made at the next 10-year interval.

Life

  • Constitutional protection of human life in American jurisdiction.
  • Ban euthanasia.
  • Ban abortion. As a child of U.S.-citizen parents is a U.S. citizen, the child is protected by U.S. law. U.S. parents who "abort" their children in foreign lands, then, become subject to murder charges should they return to the U.S. or be extradited.

Property

  • Repeal RICO, PATRIOT, and anything else that takes property away from citizens.
  • End imminent domain.
  • End condemnation of property.
  • End all zoning ordinances.
  • End COs, permits, and inspections.
  • End any form of property tax (just in case ending all taxation isn't clear enough).
  • End all government seizures of property for any reason.
  • Constitutional amendment to protect private property from any government usurpation or theft. This implies an amendment of the Fourth Amendment, too, further restricting search and seizure.

Taxes

  • Forgive all tax debt.
  • Repeal the Sixteenth (income tax) Amendment.
  • Constitutional amendment to repeal this clause of Article I, Section 8: The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States. Instead, this clause shall read: The Congress shall have Power to provide for the common Defence of the United States.
  • Repeal all taxes. Taxation is theft. Any financial support of government must be contractual and voluntary.
