Border Guards Defenseless

|

It's tough to win a war when our troops are not allowed to fire their weapons:

A team of Mexican drug smugglers unloaded $1 million worth of drugs across the U.S. border, spraying bullets at U.S. Border Patrol agents with automatic weapons, but the agents dared not return fire – as one official said they fear losing their jobs or ending up behind bars like agents Ignacio Ramos and Jose Compean.

It's Mexico, for crying out loud! It's just another two-bit (maybe three-bit) Central American despotism largely run by criminals, openly intent on the destruction of the U.S. The solution is a simple, three-point plan:

  1. Shoot-to-kill anyone coming over the border illegally (and anyone already here illegally).
  2. When Mexican authorities don't stop the invasion themselves, conquer the "nation" outright. They're certainly no match for the American military!
  3. Tax the hell out of the conquered Mexicans. Maybe we can finally get reimbursed for the billions we've spent on their citizens/criminals.

'Attempted hit' put on Ramos family

http://www.worldnetdaily.com/?pageId=86141

The family of imprisoned Border Patrol agent Ignacio Ramos was the victim of an attempted hit on their lives this month, as the agent's wife says someone broke into their El Paso home and filled it with gas, trashing photographs and pummeling their dog.
...
They even beat her dog and ripped cherished wedding pictures and family photos of their life with Ignacio off the walls, smashing them on the ground.
...
Her son opened the front door and discovered the strong odor.

"Right away he alerted me," she said. "He started yelling, 'Mom, don't walk in. Don't bring my brothers.' He said, 'The gas is on!' He ran in and started turning everything off."

Her father, Joe Loya, wrote on his blog, "Thank God no one turned on a light! Monica and her three boys would be gone!"

Monica said she believes the gas was left on for two days.

Worse:

Three months ago, his high school hosted a career day. Border Patrol agents spoke with students about the field.

Monica said one Border Patrol agent stood in front of the student body and said, "I know many of you may have heard about this Ramos-Compean case, and we just want you to know that we got rid of two bad apples. You know, not all agents are rogue agents. They're not out to break the laws."

With a$$h---s like this "guarding" our borders, it's no wonder we're overrun with violent criminals and would-be terrorists.

Bush finally cut their sentences

http://www.wnd.com/index.php?fa=PAGE.view&pag...

President Bush commuted the prison sentences of former Border Patrol agents Ignacio Ramos and Jose Compean today.

The announcement came on the last full day of Bush's presidency. The sentences for Ramos and Compean are scheduled to expire March 20 but there was no immediate explanation for the time period between today's announcement and that date.

Two years ago, Ramos and Compean began serving sentences of 11- and 12- years respectively for a 2005 incident in which they fired on a drug smuggler as he fled back into Mexico after bringing 750 pounds of marijuana into the U.S. near Fabens, Texas.

Later in the article...

The smuggler was granted immunity for his illegal activities in return for testifying against the agents. After the trial, it was revealed the smuggler participated in another drug run into the U.S. while he held immunity.

URGH! That makes me sick, besides the attempted hit on the Ramos family.

My one question concerning this is, when Obama is president, can he reverse this ruling by Bush? Or does it stand no matter what?

Pardons and Reprieves

Legally, the President may only grant pardons and/or reprieves. The former wipes out the charges and the sentence. The latter merely reduces (or eliminates) the sentence. In this case, Bush gave reprieves (commuting is this context should be called reprieve). This means he left the convictons intact, still neutering the Border Patrol.

As for Osbama, he may not legally override Bush except to shorten their sentences further (reprieve) or pardon them altogether. The President does not have the legal authority to lengthen a sentence or "unpardon".

UPDATE: Of course, what the President can do legally has little to nothing to do with what he can actually do, given the power over which he has command (legally or otherwise) and the complacency of the populace.
